Sahuarita Municipal Court
The following cases were heard on Nov. 13 unless otherwise indicated. Information on these cases was provided by the Sahuarita Town Prosecutor’s office.
Benjamin Amezcua, did not show up for a scheduled bench trial on a charge of reckless driving and Judge Maria Avilez agreed to issue a warrant for his arrest. He is accused of driving in an unsafe manner in the parking lot at the Rancho Sahuarita clubhouse and nearly running over a pedestrian and her dog.
Paul Koprivnak III, 52, Marana, was given a continuance until Jan. 8 when the victim did not show up for a scheduled trial on seven counts of domestic violence/violation of a court order. He was accused of writing seven letters in care of the daughter of a woman who had obtained an order of protection against him. Town Prosecutor Chris Wencker said some of the letters, while bearing the name of the victim’s daughter on the envelope, actually were written to, and named, the original victim. Koprivnak said in court that he was upset that he had brought his parents, who are in their 80s, to the trial only to find out the victim did not show up.
Miguel Espala Jr., 28, Tucson, who was in custody and appeared for a hearing on proposed revocation of his probation, was found in contempt of court and was sentenced to time served, 15 days, and was released. He also was sentenced to 12 months probation; 16 hours drug education; 25 hours community restitution and monthly payments of $70 toward his balance owed of $1,685 and must appear at a Jan. 12, 2009 review hearing and show he has completed half his community restitution and drug education. He said that he could not pay the fines because economic times are tough, but said he smoked his own rolled tobacco cigarettes and drank an estimated 12-pack of beer each weekend, which led the Town Prosecutor to assert that he was spending about $75 a month on tobacco and beer while not paying his fines. His underlying charges included possession of paraphernalia, possession of marijuana and failure to appear. In June, 2006 he had been ordered to complete drug education, but he did not complete it and after his probation ran out a year later, a warrant was issued for his arrest and he was arrested in April, 2008.
Arrests and Citations
Rafael Sanchez, 27, Sahuarita, on Nov. 7 at 1:30 a.m. at Denny’s restaurant, 18875 S. Nogales Hwy., was charged with two counts of assault as well as disorderly conduct and criminal trespass in the 3rd degree. Also charged were: Stephanie Alcaniz Vazquez, 28, Sahuarita, disorderly conduct, and Kristin Michelle Alcaniz, 25, Sahuarita, disorderly conduct and criminal trespass in the 3rd degree. A party of six or seven people entered the restaurant and were loud, using profanity and were asked to leave several times, police were told. Sanchez yelled at a server and was asked to leave by a patron, then Sanchez allegedly attacked the patron and had to be restrained by the server. Alcaniz and Vazquez allegedly interfered with police officers at the scene and Vazquez was handcuffed. The victim asked that charges be pressed and Sanchez was handcuffed and taken to jail.
Ricky Dell Moreland, 34, Sahuarita, on Nov. 6 at 6:30 p.m. at home was charged with domestic violence/assault and domestic violence/disorderly conduct. He told police he beat a teenage relative with a belt because she was disrespecting him in his home and that he had every right to discipline her. He told police he tried to whip her on the butt, but that she kept squirming around and he wound up hitting her on the arms. He said she cursed him out when she came home and she said he was upset because she didn’t acknowledge him when she came home.
Robert Joseph Proctor, 45, Tucson, on Nov. 7 at 10:20 p.m. near Nogales Highway and Sahuarita Road, was cited for possession of drug paraphernalia and lying to police when he allegedly gave a false name when the vehicle he was riding in was stopped. He admitted a pipe that police saw on the floorboard of the vehicle was his.
Eric Earl Furnas, 22, Sahuarita, on Nov. 5 at 7:10 a.m. near Nogales Highway and Sahuarita Road, was cited for exhibition of speeding (racing) and driving with no insurance after he accelerated through the intersection, causing his tires to squeal and emit smoke.
John R. Bolling, 54, Amado, on Nov. 7 at 4:15 p.m. at Sahuarita High School was cited for disrupting an educational facility after he went to the office and got into a finger-pointing incident with a school employee.
Christopher Alan Butler, 35, Sahuarita, on Nov. 9 at 3:15 p.m. at his home was cited for domestic violence/assault, as was his wife, Sherry Lynn Simmons-Butler, 29, after they allegedly fought. She told police she felt like a prisoner in her home with a 6-month old baby because he would not let her go anywhere, and she wanted a divorce.
Myriam Rosas, 28, Sahuarita, on Nov. 4 at 4 p.m. was cited for having no license for her two year old male white poodle named Cheeto.

Cruz Ramos Jr., 30, Sahuarita, Oct. 30 at noon, at his house, was charged with animal neglect because he had his Boston terrier on a leash tied to a dumbbell on his porch, which is considered a tie-out, and therefor illegal, even though the canine had access to water and shade.
