Sahuarita Municipal Court

Cases heard on Tuesday, Aug. 5, unless otherwise noted.

  • Cruz Ramos Jr., 30, Sahuarita, pleaded conditionally guilty to two domestic violence charges, resisting arrest and preventing the use of a telephone to call 9-1-1 to report an emergency and pleaded no contest to unlawful imprisonment. He was given $1,618 in suspended fines, a $75 prosecution fee and was ordered to complete domestic violence counseling and undergo alcohol evaluation and any recommended treatment.

  • Benjamin Amezcua, 19, Sahuarita, was scheduled for a bench trial at 1:30 p.m. Sept. 18 on a reckless driving charge and was released from custody on another case in which he had been held in contempt.

  • Anthony James Psomas, 19, Sahuarita, was ordered to begin drug treatment immediately and was placed on 12 months supervised probation. He was given a 10 a.m. Sept. 29 review hearing.

  • Tracy Dawn Berry, 38, Sahuarita, who had been released from custody since her last court date, pleaded guilty to two cases of shoplifting and was fined $268 in each case and ordered to complete an anti-shoplifting class. In another case, she pleaded guilty to criminal damage and was fined $232.

  • Barry Burdette, 35, pleaded guilty to failure to appear and was fined $268, which brought his total owed to $1867.71.

  • Johnathan Curtis Huddleston, 20, Sahuarita, pleaded conditionally guilty to possession of marijuana and drug paraphernalia and was given 16 hours’ drug education, a $75 prosecution fee and suspended fines of $1,658.

  • Matthew Thomas Donahue, 37, Tucson, who was in custody, pleaded guilty to failure to appear and was fined $257. With adjustments for time served and a collections fee, his previous balance was increased to $683 and he was ordered to make payments of $227 a month or pay a bond of $683. His underlying charges stemmed from a 2002 case.

  • Ashley Nicole Gonzalez, 19, Sahuarita, won dismissal of charges of criminal trespass and contributing to the delinquency of a minor after she completed a civic responsibility workshop as part of an informal diversion.

  • Francis H. Bates, 33, Tucson, pleaded conditionally guilty to driving on a suspended license and was set for a civil hearing on Sept. 3 on a charge of driving left of center. On the conditionally guilty charge, if he produces a valid license, he can plead guilty to a lesser charge and reduce his fine from $550 to $143.

  • Sergio Villa, 27, Tucson, who had been charged with driving on a suspended license and skipping his arraignment, showed he had gotten his license reinstated and instead pleaded responsible to not having a license in his possession and was fined $193.97. Other charges were dropped.

  • Jeffrey Lawrence Jorgenson Jr., 23, Sahuarita, was found in contempt of court for failing to pay his fines on an underlying charge of criminal trespass and was sentenced to 17 days in jail to pay off the criminal balance of his fines.

  • Elizabeth Holt, 25, Sahuarita, was set for trial Sept. 25 at 10 a.m. on a charge that her dog attempted to bite a neighbor. Other charges were dismissed after she produced licenses for her dogs and after an animal control officer failed to show up in court. She was offered a plea bargain on the bite charge, but did not accept it. The alleged victim is a neighbor who has been in dispute with the defendant.

  • Jose Armando Flores, 39, Sahuarita, an off-duty Tucson police officer, underwent a trial on Thursday and Friday on charges of disorderly conduct for stopping and yelling at another motorist and putting his hand on his service revolver during a traffic altercation that occurred on Oct. 13, 2007, on Pima Mine Road and Rancho Sahuarita Boulevard. Officials expected a verdict this week.

    Flores was driving home from work and was driving behind another vehicle that was driving considerably slower than the speed limit. The other vehicle’s driver apparently slammed on his brakes several times, nearly causing an collision, and after they both rounded the corner and both vehicles were southbound on Rancho Sahuarita Boulevard, the other vehicle pulled over to the right and stopped. Flores stopped behind and to the left of the other vehicle and Flores got out of his vehicle. Flores had his police uniform on but had a shirt on over the uniform and did not identify himself as an officer. The other driver said he had stopped so Flores could pass him and when he saw Flores put his hand on his gun, he drove off.

    Both drivers later called 9-1-1 to report the incident. Defense lawyer David Quantz said that the victim’s account differed each time he told it, but Town Prosecutor Chris Wencker said that while the wording was different, the essential story was the same, that Flores had reached for his gun without identifying himself as an officer. Quantz also said that Flores was responding as any trained police officer would in that situation. Several Tucson police officers came to court prepared to act as expert witnesses, but were not permitted to testify.

    Arrests and Citations

  • James Allen Arbogast, 19, of Sahuarita, at 11 a.m. on July 28 at the apartment complex at 1091 W. Beta Street, was charged with criminal damage and disorderly conduct. In the same incident Richard Conrad Sperle Jr., 19, of Sahuarita, was charged with assault.

    Arbogast told police one occupant of an apartment in that complex gave him permission to stay there that night and he let himself in with a credit car, knowing the deadbolt was not in use. When the occupant’s roommate, a woman, showed up with Sperle, the female roommate discovered Arbogast had locked the door in such a way that she could not get in, so she knocked and Arbogast at first refused to open up. She then threatened to call police and Arbogast did open the door, only to be struck by Sperle, both agree.

  • Patricia Sharon Vandiver, 60, Amado, was charged with shoplifting on July 26 at 1:30 p.m. at Wal-Mart. She told police she put several items in her purse and paid for bananas, then tried to walk out without paying for the other items. She told police she had the money to pay for them but had an impulse to leave without paying.

  • Leslie M. Fitzpatrick, 34, Sahuarita, on July 29 at 7:14 p.m. was charged with assault and criminal trespass after she allegedly got into an altercation with a neighbor over her dogs running unleashed into the neighbor’s yard and house. She was said to have banged the victim’s head against a brick wall before she went into her house, losing a sandal in the process. She later told police she never went onto the neighbor’s property or into her house, then was asked how her sandal got lost on the property. After a pause, she said she did not know what the officer was talking about and was cited.

  • Bradley Keller, 42, Sahuarita, on Aug. 3 at 6:30 p.m. was charged with disorderly conduct for threatening three teenagers at a park and nearly hitting them with his truck. He admitted to police he had exchanged words with the youths at the park.

  • James William Klenzendorf, 63, Corona del Tucson, on July 23 at 10:11 p.m. was charged with drunken driving after police found him asleep at the wheel of his vehicle, with the engine running, in the parking lot at Fry’s on Rancho Sahuarita Boulevard. Police were called by an employee and had a hard time rousing Klenzendorf from his slumber. He said he was looking for a drug store and had not been drinking. Town Prosecutor Chris Wencker said that although the vehicle was not moving, the engine was on and the defendant can be prosecuted for drunken driving in that set of circumstances. He also noted that drunken driving can be prosecuted on private property, such as a parking lot, unlike most traffic-related offenses.

  • Jesus Adan Quijada-Iriqui, 36, Aconchi, Sonora, Mexico, on July 26 at 1 a.m. on Nogales Highway at milepost 50, was charged with driving with an open container of alcohol and driving left of center. He was stopped after a police officer saw him crossing the center line.

    The responding officer and a sergeant who speaks Spanish conducted a check for warrants and used a laptop computer to check the defendant’s name in a law enforcement database, then pulled up a photograph and verified that the defendant was the same as a person for whom a warrant had been issued and took him to Pima County Jail. The warrant was for failure to comply with a court order regarding drunken driving. A passenger also was arrested and taken to jail.

  • A 17-year-old Sahuarita male was cited for driving on a suspended license on July 27 at 2 a.m. near Rancho Sahuarita Boulevard and Rancho Tierra. He was stopped because a police officer could not read his license plate.
